In-app payment terms

This is a translation provided for convenience. In case of any discrepancy, the Italian version prevails.

These terms govern payments for bookings made through ArteDiStrada.com ("the portal"), operated by Uranda Group Ltd, 12a Brickfields Industrial Estate, Finway Road, Hemel Hempstead HP2 7QA (United Kingdom). They form part of the Terms and conditions; for an in-app payment, these terms prevail in case of conflict.

1. What in-app payments are

1.1. A booking is an agreement for a performance between an organiser and an artist, made on the portal (invitation, application to a listing, offer in chat). The booking contract is between organiser and artist: the portal is not a party to it, but for bookings paid in the app it holds the payment and transfers it according to these rules.

1.2. Payments are processed by Stripe. Card details are handled by Stripe: the portal neither sees nor stores them. By using in-app payments you also accept the Stripe terms that apply to you: for artists the Connected Account Agreement, for everyone the Stripe Services Agreement as applicable.

1.3. A booking is paid in the app only if, at the moment it is created:

Otherwise the booking is paid outside the portal, directly between the parties: the portal does not collect, hold or withhold anything, and these terms do not apply to that payment. The payment method is shown on the booking and does not change after it is created, even if the artist changes plan.

1.4. A booking without a stated fee does not involve in-app payments.

2. Amounts and commissions

2.1. Fee. The amount agreed for the performance, in euros.

2.2. Organiser's service fee. A service fee, as a percentage of the fee and according to the organiser's plan, is added for the organiser. The percentage shown on the Pricing page at the moment the booking is created applies to the whole booking. The total amount (fee plus service fee) is shown to the organiser before payment.

2.3. Artist's commission. The commission set by the artist's plan (currently 7% on Pro, 5% on Premium), also fixed when the booking is created, is deducted from the fee. The artist receives the fee net of this commission.

2.4. Stripe's payment processing costs are borne by the portal and are not added to the amounts shown.

3. Payment by the organiser

3.1. When a booking paid in the app is confirmed, the organiser receives the payment request and pays the full amount (fee plus service fee) in a single payment, by card or with the other methods offered on the payment page. The bank may ask for verification (for example 3D Secure): this is why the organiser pays in person, even when it was the artist who confirmed the booking.

3.2. Deadline. Payment must be made within 48 hours of the request and in any case no later than midnight (Italian time) at the start of the event day. If the event is very close, the deadline is at least 2 hours after the request. The deadline is shown on the booking and in the request email; a reminder is sent when 24 hours or less remain.

3.3. Non-payment. If the payment has not succeeded by the deadline, the booking is cancelled automatically and both organiser and artist are notified. No amount is due. A payment that nevertheless arrives on a booking already cancelled is refunded in full.

3.4. The card used may be saved for the same user's later payments (for example the renewal of their plan), as stated on the payment page.

4. Holding and transfer to the artist

4.1. The amount paid is held in the portal's account with Stripe until the booking is completed. While held, it is available neither to the organiser nor to the artist.

4.2. Completion. The booking is completed when:

4.3. On completion the portal transfers the fee, net of the artist's commission (point 2.3), to the artist's Stripe account. The payout to the artist's bank account is made by Stripe, according to its payout schedule. If a transfer fails, the portal retries it and staff are notified.

4.4. The organiser's service fee and the artist's commission are retained by the portal only for completed bookings (except as provided in point 5.3).

5. Cancellations and refunds

5.1. A booking paid in the app can be cancelled by the organiser or the artist from their own area, up to and including the day of the event (Italian time). Before confirming, the portal shows what will happen to the payment.

5.2. If the artist cancels, the organiser receives a full refund (fee plus service fee).

5.3. If the organiser cancels:

5.4. Before payment a booking can be cancelled with no amount due.

5.5. After the day of the event the booking can no longer be cancelled from your own area. Anyone who believes the performance did not take place, or not as agreed, must report it to staff before the automatic completion (point 4.2), with "Ask for support" or by writing to assistenza@artedistrada.com. Staff assess the report after hearing both parties and may cancel the booking ordering either a full refund to the organiser or the transfer of 30% of the fee to the artist, giving reasons to both.

5.6. Refunds are returned to the same payment method used; the time taken to credit them depends on the bank or card issuer.

5.7. Before disputing a charge with your bank, please write to us: the problem is almost always solved faster with our staff.

6. Obligations of the parties

6.1. The organiser pays in the app for bookings paid in the app and neither requests nor accepts payments for the same booking outside the portal.

6.2. The artist keeps the Stripe account details accurate and is responsible for their own tax and social-security obligations on the fees received. The portal does not act as a withholding agent.

6.3. Each party remains responsible to the other for the performance of the booking; the portal is responsible for the correct holding and transfer of the amounts under these terms.

7. Changes

Changes to these terms apply to bookings created after the new version is published; bookings already created remain governed by the version in force when they were created, including the commission percentages.

8. Complaints and disputes

For complaints, governing law and jurisdiction, points 9.1, 9.2 and 9.3 of the Terms and conditions apply.
